Welcome to BookMyDay. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Offer18 Tracking Platform Pvt. Ltd. ("BookMyDay", "we", "us", or "our"), governing your access to and use of the BookMyDay platform, including our website at bookmy.day, mobile applications, APIs, and all related services (collectively, the "Service").

Please read these Terms carefully before using the Service. By creating an account, accessing, or using BookMyDay in any way, you agree to be bound by these Terms, our Privacy Policy, Acceptable Use Policy, and all other policies referenced herein.

1. Acceptance of Terms

By accessing or using the Service, you confirm that:

• You have read, understood, and agree to these Terms and all incorporated policies.
• You are at least 18 years of age and have the legal capacity to enter into a binding agreement.
• If you are using the Service on behalf of an organisation, you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and the organisation.

If you do not agree to any part of these Terms, you must not use the Service.

2. Service Description

BookMyDay is an online scheduling and appointment booking platform that enables businesses and individuals to:

• Create customisable booking pages and event types for one-on-one, group, and round-robin meetings.
• Sync with third-party calendars (Google Calendar, Microsoft Outlook, Apple Calendar) to manage availability and prevent conflicts. For Google Calendar, we request full read and write access to create, update, and delete events on your behalf.
• Automatically generate Google Meet video conference links for virtual appointments and attach them to calendar events.
• Send automated email and SMS confirmations, reminders, and follow-ups.
• Collect payments and deposits at the time of booking through integrated payment gateways.
• Embed scheduling widgets on external websites.
• Access analytics, reporting, and team management features.

We continuously improve and update the Service. Features may be added, modified, or removed at our discretion with reasonable notice.

3. User Accounts

3.1 Registration

To access most features, you must create an account by providing accurate, current, and complete information. You agree to update your information promptly if it changes.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password and keep it confidential.
• Notify us immediately at contact@bookmy.day if you suspect unauthorised access to your account.
• Not share your account credentials with any third party.

We are not liable for any loss or damage arising from your failure to secure your account.

3.3 Account Types

BookMyDay offers various account types (Free, Professional, Team, Enterprise) with different feature sets and usage limits. Details are available on our pricing page.

4. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated by reference. In addition, you agree not to:

• Use the Service for any unlawful, fraudulent, or malicious purpose.
• Violate any applicable local, national, or international law or regulation.
• Interfere with, disrupt, or attempt to gain unauthorised access to the Service, its servers, or connected networks.
• Upload, transmit, or distribute viruses, malware, or other harmful code.
• Use the Service to send unsolicited bulk messages (spam) or engage in phishing.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Scrape, harvest, or collect data from the Service using automated means without our written consent.
• Resell, sublicense, or redistribute the Service without our express permission.

5. Payments and Billing

5.1 Subscription Plans

Paid features are available through subscription plans billed on a monthly or annual basis. By subscribing, you authorise us to charge the applicable fees to your designated payment method.

5.2 Pricing and Fees

All fees are quoted in the currency displayed at checkout and are exclusive of applicable taxes unless stated otherwise. We reserve the right to modify pricing with at least 30 days' written notice. Price changes will take effect at the start of your next billing cycle.

5.3 Payment Processing

Payments are processed securely through third-party payment processors (e.g., Stripe, Razorpay). By providing payment information, you represent that you are authorised to use the payment method and consent to the processor's terms.

5.4 Refunds

Subscription fees are generally non-refundable. However, if you cancel within 7 days of your initial purchase or annual renewal, you may request a full refund. Refund requests should be directed to contact@bookmy.day.

5.5 Failed Payments

If a payment fails, we will attempt to process the charge up to three additional times over the following seven days. If payment cannot be collected, we may downgrade your account to the free plan until a valid payment method is provided.

6. Intellectual Property

6.1 Our Intellectual Property

All content, features, functionality, design, code, trademarks, logos, and branding of BookMyDay are the exclusive property of Offer18 Tracking Platform Pvt. Ltd. and are protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

6.2 Your Content

You retain ownership of all content you upload or create through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to use, store, display, and transmit your User Content solely to the extent necessary to provide and improve the Service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use and incorporate such feedback without any obligation to you.

7. Data and Privacy

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the data practices described therein.

If you process personal data of third parties (e.g., your clients' booking information) through the Service, you are responsible for ensuring you have the necessary legal basis and consents to do so, and for complying with all applicable data protection laws.

8. Service Availability

We strive to maintain 99.9% uptime for the Service but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible).
• Emergency maintenance to address security vulnerabilities or critical issues.
• Factors beyond our reasonable control, including internet outages, third-party service failures, natural disasters, or government actions.

We are not liable for any damages resulting from Service downtime or interruptions.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• In no event shall BookMyDay, Offer18 Tracking Platform Pvt. Ltd., or its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, arising from your use of or inability to use the Service.
• Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount paid by you to BookMyDay in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BookMyDay and Offer18 Tracking Platform Pvt. Ltd., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Service or violation of these Terms.
• Your User Content or any data you process through the Service.
• Your violation of any applicable law or third-party rights.

11. Termination

11.1 Termination by You

You may close your account at any time by contacting us at contact@bookmy.day or through the account settings. Upon closure, your subscription will not renew, and you will retain access until the end of your current billing period.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You breach these Terms or any incorporated policy.
• We are required to do so by law or a valid legal order.
• Your use poses a security risk or may cause harm to other users or the Service.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days to allow retrieval, after which it will be permanently deleted unless retention is required by law. Sections of these Terms that by their nature should survive termination shall remain in effect.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Punjab, India.

Before initiating any legal proceedings, you agree to attempt to resolve the dispute informally by contacting us at contact@bookmy.day. We will endeavour to resolve disputes within 30 days of receiving notice.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Post the updated Terms on this page with a revised "Last updated" date.
• Notify you via email or in-app notification at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of the Service.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, Acceptable Use Policy, Cookie Policy, and Data Processing Addendum, constitute the entire agreement between you and BookMyDay.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
• Force Majeure: We are not liable for failure to perform obligations due to circumstances beyond our reasonable control.
