This Acceptable Use Policy ("AUP") governs your use of the BookMyDay platform and all related services operated by Offer18 Tracking Platform Pvt. Ltd. This policy is incorporated by reference into our Terms of Service and applies to all users, including free and paid account holders.
By using BookMyDay, you agree to comply with this AUP. We reserve the right to update this policy at any time, and your continued use of the Service constitutes acceptance of any changes.
1. Purpose
The purpose of this Acceptable Use Policy is to ensure that BookMyDay remains a safe, reliable, and trustworthy platform for all users. This policy outlines the activities that are prohibited when using our Service and the actions we may take to enforce compliance.
We expect all users to act responsibly, respect the rights of others, and use the platform in a manner consistent with its intended purpose — professional scheduling, appointment management, and business communications.
2. Prohibited Activities
You agree not to use BookMyDay to engage in, facilitate, or promote any of the following prohibited activities:
2.1 Spam and Unsolicited Communications
- Sending unsolicited bulk emails, SMS messages, or notifications through the platform.
- Using the Service to distribute marketing messages to individuals who have not consented to receive them.
- Creating fake or misleading booking pages designed to collect contact information for spamming purposes.
- Using automated tools or scripts to send mass invitations or booking requests.
- Harvesting email addresses or other contact information from the platform for use in unsolicited communications.
2.2 Abuse and Misuse of the Service
- Creating multiple accounts to circumvent usage limits, bans, or other restrictions.
- Using the Service in a manner that degrades performance, availability, or reliability for other users.
- Exploiting bugs, vulnerabilities, or errors in the platform instead of reporting them responsibly.
- Attempting to gain unauthorised access to other users' accounts, data, or administrative features.
- Using the Service to conduct denial-of-service attacks, load testing, or stress testing without written authorisation.
- Circumventing or attempting to circumvent rate limits, security controls, authentication mechanisms, or access restrictions.
2.3 Illegal Content and Activities
- Using the Service to promote, facilitate, or engage in any activity that violates applicable local, national, or international laws and regulations.
- Creating booking pages or event types that facilitate illegal transactions, including the sale of prohibited goods or services.
- Using the platform for money laundering, terrorist financing, fraud, or other financial crimes.
- Distributing content that infringes on the intellectual property rights of others, including copyrighted materials, trademarks, or trade secrets.
- Using the Service to engage in identity theft, phishing, or social engineering attacks.
2.4 Malicious Code and Security Threats
- Uploading, transmitting, or distributing viruses, worms, trojans, ransomware, spyware, adware, or any other malicious software or code.
- Injecting malicious scripts, SQL injection payloads, cross-site scripting (XSS) attacks, or other exploit code through booking forms, custom fields, or any input mechanism.
- Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service.
- Interfering with security features, encryption mechanisms, or authentication systems.
2.5 Harassment and Harmful Content
- Using the Service to harass, threaten, intimidate, stalk, or bully any individual or group.
- Publishing or transmitting content that is defamatory, obscene, hateful, discriminatory, or incites violence against any person or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Using booking pages or communications to spread false information, disinformation, or misleading content that may cause harm.
- Creating fake profiles or event types designed to deceive or defraud other users.
2.6 Data Scraping and Unauthorised Data Collection
- Using automated tools, bots, crawlers, scrapers, or similar mechanisms to extract, collect, or download data from the platform without our express written consent.
- Systematically accessing the platform or API to build competing products, databases, or services.
- Collecting, storing, or processing personal data of other users in violation of applicable data protection laws.
- Using the platform's API in ways that exceed the authorised scope or rate limits specified in our API documentation.
- Aggregating, republishing, or redistributing data obtained from the Service without authorisation.
3. Enforcement
We take violations of this AUP seriously. Upon becoming aware of a potential violation, we may take any or all of the following actions at our sole discretion:
- Warning: Issue a written warning to the account holder specifying the violation and requesting immediate corrective action.
- Content Removal: Remove, disable, or restrict access to content that violates this policy.
- Feature Restriction: Temporarily limit access to specific features or functionality.
- Account Suspension: Temporarily suspend the offending account pending investigation.
- Account Termination: Permanently terminate the account and delete associated data, with or without prior notice in cases of severe or repeated violations.
- Legal Action: Pursue legal remedies, including reporting violations to law enforcement authorities where appropriate.
The severity of enforcement action will be proportional to the nature and impact of the violation. We will endeavour to notify the account holder before or at the time of enforcement, except where doing so would compromise an ongoing investigation or pose a risk to the platform or other users.
Users whose accounts are suspended or terminated for policy violations may appeal the decision by contacting contact@bookmy.day within 14 days. Appeals will be reviewed by a member of our trust and safety team and a decision communicated within 10 business days.
4. Reporting Violations
If you become aware of any activity on BookMyDay that you believe violates this Acceptable Use Policy, we encourage you to report it promptly. You can submit a report by:
- Emailing contact@bookmy.day with the subject line "AUP Violation Report".
- Using the contact form on our website.
When reporting a violation, please include as much detail as possible:
- The URL or description of the content or activity in question.
- The date and time of the observed violation.
- Your contact information (optional, but helpful for follow-up).
- Any screenshots or evidence supporting your report.
All reports are treated confidentially. We will investigate each report in a timely manner and take appropriate action. We do not tolerate retaliation against individuals who report violations in good faith.
5. Changes to This Policy
We may update this Acceptable Use Policy from time to time to address new types of abuse, reflect changes in the law, or improve clarity. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Notify users via email or in-app notification at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of the updated policy constitutes your acceptance of the changes. We encourage you to review this policy periodically.
